SUMMARY:
This item is associated with the Borough's existing swimming pool ordinance. This section of the code provides a basic framework for regulating these facilities. However, because it has not been updated in decades, it features several deficiencies. It is necessary to alter four sections of the text to safeguard against any legal challenges:
1) The definition of swimming pool is not consistent with the current requirements of the Uniform Construction Code. Any basin that is capable of holding 24 inches of water, including inflatable pools, is subject to enforcement.
2) The text does not reference that Borough's adoption of the International Plumbing Code to control water supply & drainage standards.
3) The ordinance requires that all swimming pools be directly connected to the sanitary sewer. However, the Plumbing Code presently mandates an air gap between the terminus of the wastewater line and its point of entry into the sewer lateral.
4) The text does not reference the Borough's adoption of the International Pool & Spa Code to control standards for installation and for the placement of ladders and decks.
